정도전의 사상이 굳어진 곳은 조정이 아니라 유배지였다.

1375년, 그는 원의 사신을 맞는 문제로 권신들과 부딪쳐 전라도 나주 회진현으로 유배됐다. 명문가 출신이 아니었던 데다 외가 쪽 신분 문제로 늘 공격받던 처지였다. 그곳에서 3년 가까이 농민들과 부대끼며 살았다.

뒷날 그는 그 시절의 경험을 여러 글에 남겼다. 백성이 국가의 근본이라는 그의 말은 관념이 아니라 그때 본 것에서 나왔다는 해석이 유력하다.

1383년 함주로 이성계를 찾아간 것이 전환점이었다. 군사력을 가진 무장과 설계도를 가진 문인이 만났다.

사상의 핵심

정도전의 핵심은 재상 중심의 정치, 곧 신권론이다.

그의 논리는 이렇다. 왕은 세습된다. 세습되는 자리에는 현명한 사람이 올 수도 있고 아닐 수도 있다. 그것은 운이다. 반면 재상은 능력으로 뽑을 수 있다. 그렇다면 나라의 실제 운영은 뽑을 수 있는 자리가 맡고, 왕은 그 재상을 고르는 역할에 집중해야 한다.

조선경국전에서 그는 국가의 통치 구조를 이 원칙 위에 짰다. 육전 체제를 세우고 각 부처의 권한과 절차를 규정했으며, 언관의 비판 기능을 제도로 못박았다. 개인의 덕이 아니라 제도가 돌아가게 만들려 한 것이다.

불씨잡변에서는 불교를 정면으로 논박했다. 불교가 인륜을 저버리고 국가 경제에 부담을 준다는 비판이었다. 이는 단순한 종교 논쟁이 아니라, 새 왕조의 이념적 지반을 성리학 하나로 정리하는 작업이었다.

한 일

한양 천도와 경복궁 설계가 그의 손에서 나왔다. 궁궐과 전각의 이름도 대부분 그가 지었다. 경복궁이라는 이름은 시경에서 따온 것으로, 큰 복을 누리라는 뜻이다.

그가 설계한 것은 건물만이 아니었다. 법전, 관제, 병제, 교육 제도까지 조선이라는 국가의 뼈대 대부분이 그의 구상에서 나왔다. 조선왕조 5백 년이 그가 만든 틀 안에서 굴러갔다는 평가가 과장이 아니다.

그러나 1398년, 이방원이 일으킨 제1차 왕자의 난에서 그는 죽었다. 신권을 강화하려는 그의 구상은 왕권을 세우려는 이방원과 정면으로 충돌할 수밖에 없었다.

논쟁과 평가

정도전에 대한 평가는 조선 내내 억눌려 있었다. 태종을 거스른 인물이었기 때문이다. 그가 공식적으로 복권된 것은 고종 대에 이르러서였다. 5백 년 가까이 걸린 셈이다.

그의 재상중심론을 근대적 의미의 권력분립이나 입헌주의로 읽으려는 시도가 있으나, 여기에는 신중할 필요가 있다. 그가 말한 재상은 선출된 대표가 아니라 왕이 임명하는 최고 관료였고, 그의 구상 어디에도 백성이 통치자를 뽑는다는 발상은 없다.

다만 통치를 개인의 자질이 아니라 제도의 문제로 본 것, 최고 권력자를 견제할 장치를 체계 안에 넣으려 한 것은 분명한 성취다. 근대의 언어로 번역하지 않고도 그 자체로 평가할 수 있는 대목이다.

오늘의 질문 앞에서

권력을 어떻게 배치할 것인가. 세습되는 자리에 실권을 줄 것인가, 뽑을 수 있는 자리에 줄 것인가.

정도전은 6백 년 전에 이 질문을 던졌고, 그 답을 제도로 옮기려다 죽었다. 그가 진 이유는 논리가 약해서가 아니라 칼을 쥔 쪽이 반대편이었기 때문이다. 설계도는 그것을 지킬 힘이 없으면 종이로 남는다.

Life

Jeong Dojeon's thought hardened not at court but in exile.

In 1375 he clashed with powerful ministers over the reception of a Yuan envoy and was banished to Hoejin district in Naju, in Jeolla. He was not from a prominent family, and his maternal line left him permanently open to attack on grounds of status. He lived there for nearly three years among farmers.

He wrote about that time afterwards in several places. The leading reading is that his statement that the people are the foundation of the state came not from an abstraction but from what he saw then.

The turning point was 1383, when he went to Hamju to find Yi Seonggye. A commander with military force met a scholar with a blueprint.

The core of it

Jeong Dojeon's central claim is government centred on ministers — the primacy of the bureaucracy over the throne.

His reasoning runs like this. Kingship is inherited, and an inherited position may be filled by a wise man or may not. That is luck. A chief minister, on the other hand, can be selected on merit. Therefore the actual running of the state should belong to the selectable office, and the king should concentrate on choosing that minister well.

In his code for the new dynasty he built the structure of government on that principle: six ministries, defined powers and procedures for each, and the critical function of the censorate written into the institutions. He was trying to make the system run rather than depend on one man's virtue.

In his critique of Buddhism he took the religion on directly, arguing that it abandons human relations and burdens the state economy. This was not merely a religious dispute; it was the work of consolidating the ideological ground of a new dynasty on Neo-Confucianism alone.

What he did

The move of the capital to Hanyang and the design of Gyeongbok Palace came from his hand, and he named most of the palace buildings himself. The name Gyeongbokgung is taken from the Book of Odes and means to enjoy great blessing.

What he designed was not only buildings. The law code, the bureaucracy, the military system and the education system — most of the skeleton of the state came out of his plans. It is no exaggeration to say that five centuries of the dynasty ran inside a frame he built.

But in 1398 he was killed in the first princes' rebellion, raised by Yi Bangwon. A design that strengthened ministerial power was bound to collide head-on with a prince intent on establishing royal power.

Disputes and assessment

Assessment of Jeong Dojeon was suppressed throughout the dynasty, because he had crossed King Taejong. He was not officially rehabilitated until the reign of Gojong — roughly five hundred years later.

Attempts to read his minister-centred theory as separation of powers or constitutionalism in the modern sense call for caution. The chief minister he described was not an elected representative but the highest official appointed by the king, and nowhere in his design is there any notion of the people choosing their ruler.

What is a clear achievement is that he treated governance as a matter of institutions rather than of individual character, and tried to build a check on the highest power into the system itself. That can be assessed on its own terms, without translating it into modern vocabulary.

The question it leaves

How should power be arranged? Give real authority to the inherited position, or to the one that can be selected?

Jeong Dojeon asked this six hundred years ago and died trying to turn his answer into institutions. He lost not because the logic was weak but because the side holding the sword was the other one. A blueprint without the force to defend it stays paper.
